Pag-IBIG Housing Loan Default and Foreclosure
Most real estate purchases and investments are made with the use of borrowed money; that is by mortgage loans.
In an ideal world, these mortgages are paid on time and are eventually fully paid including all the interest incurred by borrowing the money. But unforeseen circumstances do sometimes happen, which lead to loan defaults and, worst of all, mortgages being foreclosed.
Foreclosures are often painful on the part of the borrower and a hassle on the part of the lender. This is the reason why lenders are very strict in evaluating loan applications. It is not uncommon for lenders to ask for very detailed personal and financial information from their clients.
Why Loan Defaults Happen?
Given the fact that Housing Loan Default is something to be avoided, there are some reasons why they happen. Here are some common ones:
- Personal and Financial Problems — the loss of a job, emergencies, calamities, or being assigned to another city.
- Physical Flaws Of the Property — weak structure, dilapidated roads, flood-prone area, etc.
- Legal Problems — land title disputes, marital problems
Loan Default Leads To Foreclosure
For regular Pag-IBIG Housing Loans, loan default happens when the borrower or any of his co-borrowers…
- fails to pay three consecutive monthly amortizations
- fails to pay monthly membership contributions
- fails to comply other obligations of the loan
In the case of Pag-IBIG Rent-to-Own units, a default happens if you fail to pay three consecutive monthly rentals.
If the borrower defaults on a loan, the outstanding loan, accrued interest, penalties, fees and other charges become immediately due and demandable. Aside from that, Pag-IBIG also imposes that the “unpaid monthly payments shall continue to be charged with a penalty equivalent to 1/20 of 1% of the amount due for every day of delay.”
What To Do If Foreclosure Is Underway?
A foreclosure is a very stressful situation. Once you are at a point near that, knowing the options to take can greatly help.
If you find yourself unable to continue to make the scheduled payments on a mortgage loan, consider the following alternatives before it’s too late:
1. Sell the property and repay the loan. If you are lucky to have a friend or relative who has ready cash to pay for the property, this is the way to go.
2. Have someone assume the loan. Announcing to the whole world that you are in financial distress may help after all. Who knows, someone down there might be a good candidate and he could be interested in assuming your loan.
3. Restructure the loan. Discuss this with the lender; the Pag-IBIG Fund, in this context. A Loan Restructure might help reduce the payments temporarily.
4. Just let it be. That is, just allow the lender to continue with the foreclosure. Some properties really deserved to be foreclosed, most especially those that are really giving you a lot of headache instead of a roof over your head.
Prevent Foreclosure By Avoiding Loan Defaults
As a member of Pag-IBIG Fund, loan defaults and foreclosures are things to be avoided like a dreaded virus. Remember that once you have faced a foreclosure in your Pag-IBIG Housing Loan, you may be denied housing loans in the future.
One of the ways of preventing loan default is by first being honest with your finances. Before deciding to use a housing loan, consider your monthly expenses, you may have to do away some if your house is on top of your priority list. This requires a lot of discipline.
It is also very important that you know how to buy the right property that fits your needs. Don’t even consider buying in depressed areas and unsecure or unsafe neighborhood.

i applied for pag ibig housing loan july of 2007 and was fortunate enough to have been awarded the the loan. however something happened with my finances and i failed to pay my monthly amortizations and the house and lot were foreclosed.
my question is, will i still be illegible for another housing loan if ever my finances get better?

my gusto akong i-rent na bahay na foreclosed sa Silvertowne II, Malagasang I, Imus, Cavite. Mahigit isang taon na yon pero hanggang nagayon wala pa resulta. Nag apply ako sa foreclosure section ng pag-ibig sa Atrium Makati mga June, 2009 pa. It’s best if you can visit the Pag-IBIG office and ask for a document that allows your employer to deduct from your payroll your monthly dues for that loan. Your employer may never know that you had a loan from Pag-IBIG and that document will help them, and you too.

Pag-IBIG is very strict when it comes to missed payments. I don’t know if this was explained to you during the orientation, but having a record of foreclosure on your account will not allow you anymore to another housing loan.

So technically, you don’t really own the house where you are living yet? And what did you get from that 80k?
From what I have gathered on your comment, I’m sorry to inform you that Pag-IBIG Fund has nothing to do with the transaction between you and the agent/broker or even the original buyer. There are steps to take when you assume a loan and you need to know this before even paying that 80k.

This is something you should seriously consider because it will definitely affect your standing on Pag-IBIG. Pag-IBIG might give you a chance. Just because the property is far from your place of work doesn’t give you an excuse not to pay your obligations.

almost 2 years ng in default ang payment ng housing loan ng husband ko. hindi kasi kami nakatira dun but napagawa na namin yung house (bare unit siya nung na-acquire namin). gusto ko lang sana malaman: kung ibebenta namin yung property sa ibang buyer since hindi na kami interested tumira dun para ma-cover ang mga arrears namin, is it still possible na makakuha ako ng housing loan under my name this time (since yung first loan is sa husband ko nka-pangalan).

If I will avail a Pag-ibig housing loan for 30 years, then after a few years of regular contributions, I decide to shorten the term to 15 years because I get a better financial condition, would they allow me to do so and restructure my loan? Thanks.
I have a Housing Loan, but we would not be able to live in it. There is an interested buyer who is also a Pag-Ibig Member. My question is, is it possible to transfer the housing loan to them? They will pay me what I have paid to date and they will continue? I asked, because what if I decide to purchase a new house? I would not be able to do so if I have an existing housing loan that they are continuing to pay but still under my name.

when can a loan be considered as default and subject to foreclosure?
Bev, a loan can be considered in default in a Pag-IBIG loan usually if you haven’t paid your loan amortization and/or your membership contribution in at least three consecutive months. Subsequently, the loan shall be considered due and demandable. Foreclosure proceedings start after failure of update by the borrower after demands by the Fund.

The first requirement is you must also be a member of Pag-IBIG. Get pre-qualified first if you have enough income to pay for the monthly dues. It’s better if you and your friend can go to the Pag-IBIG office to discuss it in details.

My mom loaned the construction of our house through PAG-IBIG back in 2005. She is not telling me, but i believed she is not paying the monthly amortization anymore. Maybe for more than a year now. She is not telling me if there is already a foreclosure notice or any details either.
Do you think our house is already foreclosed? If so, do you think we are eligible for restructuring? Is there a lower interest rate for OFW? I am an OFW, do you think they can transfer it to my name to avail a lower amortization?
Btw, the land where we build the house is ours. The land value as of now is definitely higher than our loan amount. Is it some sort of collateral that’s why there is no foreclosure until now?
I want to assume some responsibility cause I don’t want them to be kicked out of the house.

m.cinco: Please ask your friend about the real status of that property. They may be given the chance to redeem it. Or else, you have to wait till Pag-IBIG releases the property for public auction or for sale.

That figure is not surprising at all if the property has not be paid for a long time already. Think about the compounding effect of interest due and you know what I mean. That’s the reason most buyers will simply opt for foreclosure than save the long overdue property.
Please have someone from Pag-IBIG explain it to you. There is usually someone in-charge on cases like that.

Please englighten. I applied for a housing loan before when i was still single, but decided to not continue and have not paid i think for 3-4 years already the amortization. I have not received any foreclosure letter though.
I was actually paying the monthly amortization before with dissatisfaction because of the poor quality of the house and and i was waiting for someone to assume the place to no avail.
Now, i am married and my husband wish to purchase a house and lot for our family, will my bad standing with Pag-ibig affect the approval of his loan application?

I applied for housing loan was granted way back 1995.Since I can afford to pay monthly amortization.Again,problem occurs monthly amortization was not able to continue.The actual amount of my housing loan was raised up to 300%.Again,re-apply and giving a chance for re-structure of monthly amortization.At this point i was able to met my target because i got a good opportunity of bigger income monthly amortization continue paying back 2007 up to 2009. @Jec: The purpose of the collateral is that it serves as a security to the lender in case you fail to pay for the loan. Unfortunately, in your case, Pag-IBIG may now be the owner of that property.
@Che: Please be patient… you can have your own house in the future. At this stage, it’s better if you save enough money for the down payment and make sure that you have your finances in order so that when you apply for the loan, your chances of being approved will be high.

I can’t remember your case anymore. But you can check this one with Pag-IBIG. That letter may be sent automatically without them checking the real status.

Renting it out is a wise move on your part. Basically, you are already the rightful owner of that property even if you are still paying on your amortization.

It depends on many things. But most likely, you need to execute a Waiver of Rights. Yes you are right about getting an assistance from a Pag-IBIG personnel. As a matter of fact, both you and the buyer should go there to do this transaction.

2. The Land Title itself is already the collateral, plus the house of course. The Home Improvement is just another loan on top of the regular housing loan.

I received a foreclosure notice from Pag-Ibig for missing almost two years of payments on my amortization. I’ve had major health issues so I prioritized spending to keep myself alive first. Now I am back on my feet and would like to continue paying back my loan.
However, when I spoke to a Pag-Ibig officer on the main branch, he is quoting me an exorbitant downpayment and six-month amortization just to allow me to continue paying for the rest of my 20-year loan. Lampas na yung interest and penalties na hinihingi nya sa original amount ng loan. Parang ayaw talagang magpabayad, he’s quoting half a million as one-time initial payment and almost 100k monthly for six months para lang umandar ang transaction, he keeps saying that’s the law, “wala na ibang options”, no one I can talk to, etc.
I have valid reasons for defaulting, and I am now willing to pay back. I just want reasonable terms. Is there anybody else where I can appeal my case (please, not the same people in the foreclosure section) that would listen to reason and uphold the humanitarian cause of Pag-Ibig?

First, I’d like to let you know that I feel for you. That was indeed a vrey difficult situation. However, the Pag-IBIG Guy that you talked to
was just doing the job in his best capacity. They have to observe some guidelines and be very strict with it. I’m not sure who else you can talk to in this case. Maybe if you can find someone who is willing to buy your unit, and catch on the Pag-IBIG penalties, that would at least ease up the problem.

Thank you for the kind reply. Having someone assume the loan was one of the options I considered. However, the final price of the unit after computing in the penalties makes it more than twice the price of it’s original value. A bank wouldn’t touch it. The option of turning the loan over to a kin who is a pag-ibig member is not available to me since I don’t have siblings and my children are too young.
I am be willing to pay the penalties, if there is no way they can be condoned. However, I cannot afford to pay the whole thing in cash in one fell swoop. I just wish for a restructure of the loan, with penalties and amortization spread out in manageable chunks. Even the strictest of banks have officials that hear you out and bargain for a win-win situation.
There must be a mechanism, a forum, or a body where pag-ibig members can bargain or plead for consideration if they have justifiable reasons. I know that big developers and foreclosure speculators can get an audience all the way up to the pag-ibig board. Why is there no such mechanism for us, the common members of pag-ibig?

Halos pareho kami ng problema ni cath. Hindi ko rin mabayaran yung hininging one-time-payment halos isang taon na since foreclosure notice. Gusto ko sanang ituloy na lang muna ang pagbabayad buwan-buwan para hindi lumaki ang interest and penalties, ayaw naman tanggapin. Hindi yata interesado ang Pag-Ibig na bigyan ng pagkakataon ang members na makabayad pag nag-default, ang nasa guidelines eh bayaran upfront or surrender mo all rights (dacion en pago) kaagad. Bakit ganyan ang guidelines, diba dapat socially-responsible ang Pag-Ibig at hindi pera lang ang pinag-iinteresan?

May nakuha kasi akong row house sa Sta Rosa last 2009 thru a developer with equity na hinulugan ko ng 1 year(2010). Natapos lang ang construction ng unit this year 2011 at na-release ang Pag-ibig Housing Loan ko last June 2011. Three Months na rin akong naghuhulog thru PDCs na sinubmit ko sa developer. Di ko pa natitirhan ang bahay at di ko pa rin naaaccept. Sa ngayon nagdadalawang isip na akong tirahan ang bahay at nagiisip na i-withdraw na lang. Di rin ako nagandahan sa pagkakagawa ng bahay. Ano kaya ang magandang gawin? Ano ang maipapayo mo sa sitwasyon ko. Maraming salamat sa pag-sagot.
Hi! I’m planning on selling my house and I have a few questions that I’m hoping you can answer for me:
1. How do I go about listing my house for sale particularly getting an MLS #? Is there a fee for this? And is this the most advisable way to attract buyers?
2. Aside from property taxes and capital gains, are there any major closing costs required from the seller? Do I only pay for capital gains if I sold the property at a gain? Is it true that transaction costs can be around 10% to the seller?
3. I’m still paying the loan with Pag-ibig, can I sell/transfer this loan to the buyer?
4. If I don’t find the buyer and I decide that the best way for me is just to let the foreclosure proceedings take place, how long does it usually take until we get booted out of the house?

i am an employed pag ibig member ask ko lang when we say “net disposable income ” paano ba ang computation ng pag ibig dun : gross + allowances + OT less deduction (like w/tax , sss contribution ,etc ).
may other allowances din ako nakukuha aside from being employed .pwede rin ba yun isama sa computation ?
i also have 2 active credit cards pero only one lang ang nagagamit ko. kailangan ko rin ba i declare yun ? kasama din ba sa computaion un ? or base lang talaga sa payslip ang ” net disposable income ” ?

The main point you want to raise here is that you don’t like the property that’s why you are discouraged from continuing the loan payments. Well, I hope you will not make the wrong move of abandoning your loan obligation at Pag-IBIG. YOu may do any of the following:
1. Sell it.
2. Improve the house to suit your taste.

Mam, ask ko lang ko since nahihirapan ako sa monthly amortization at nawalan ako ng work puede ko po ba idowngrade ang model house into much affordable unit. Monthly amortization ko po is almost 14k per month possible po ba isurrender ko ang unit at kumuha na lang ng panibagong unit na mas mura. At possible po ba na itransfer lahat ng naihulog ko if in case magrant sakin.

Question lang po, balak kong ipaassume yung housing loan ko. Incase makahanap ako ng magaassume at nagkapirmahan na, do I still need to worry if the buyer will really be paying the remaing balance or not?

You have to make sure that you get off the hook when you find a new buyer. Please ask the assistance of the Pag-IBIG Staff that handles your account. You should worry, because if he is delinquent with the payment,
that means you will risk not getting another loan or even your savings with the Fund.

Most probably that property is already a candidate for foreclosure. Normally, you will be notified of your missed payments and what actions you can take to avoid losing the property. Please visit the office of the Pag-IBIG Fund that handles that account.

I received the take out letter from HDMF Sept 30, 2011. I’ve been paying my housing bill for the past months now and I can say of course that I am a good payor… My concern is for almost 3 months now, I am still waiting for the so-called “move-in”. It’s very frustrating on my part since I already waited more than 2 years to process the “take-out”. And now that I granted “take-out”, am still waiting again for “move-in….
I’ve read HDMF Circular No. 259 Article 5 on Warranties and Section I. Delivery of Accounts and Occupancy of Units. It clearly states that:
The developer shall turn-over the properties to the member-borrower upon release of the take-out at proceeds and the member-borrower can occupy these properties IMMEDIATELY!
How immediate is this IMMEDIATELY?…..Don’t you have sanction for this kind of developer?…

There is no exact time frame when it comes to the foreclosure process. All you can do it follow it up at the Pag-IBIG or if it is under the Back-back guarantee program, you need to check it with the developer.

Inquire ko lang kasi I just received a letter from pagibig na for forclosure na yung property na ni-lend ko sa kanila so from what I understand, di pa sya na-forclosed (correct me if im wrong though). theyre now giving us 15 days to pay. ask ko lang kung is it possible or kung icoconsider pa ba nila kung mag pay ako ng kahit 50% dun sa kakulangan ko? Almost 2yrs na din kasi ako di nakakabayad ng amortization due to financial crisis so medjo malaki na sya at di ko kaya mabayaran in full. Just noticed sa ibang comments kasi na di na nila tinatanggap yung mga gusto magbayad (forclosed properties) kahit willing to pay pa sila.
And matanong ko nalang din, applicable pa kaya yung account ko for restructuring? Di kasi talaga ganun kadali bayaran lalo na kung full payment ang gusto nila. Im looking forward for your advice admin and I thank you in advance.

yun developer ng binili kong property is kumuha sa akin ng 27 checks, the 3 checks is pag nagkamali daw sila ng sulat or something. nawala sa isip ko na 24 lang pala. ang nangyari tuloy-tuloy lang ako nagbabayad. hindi na pala nagwiwithdraw sila. dapat after ng 24 checks is sa pag-ibig na, so dahil endi ko naasikaso, i think nag-lapse na ako ng hulog sa pag-ibig ng 3 months. ma-po-foreclose na po ba yun?
